INITIAL STUDY ATTACHMENT <br /> PA-1000245 <br /> Forward Inc./Republic Services <br /> PROJECT DESCRIPTION: Use Permit application to amend the existing Solid Waste Facility <br /> Permit Boundaries only. Under Title 27 CCR (California Code of Regulabons). CEQA review <br /> (California Environmental Quality Act) is required to amend the facilities boundary. 184 acres of <br /> the project site is under Williamson Act contract 72-01-398. No landfill activities, waste <br /> placement, disposal composting storage of equipment, or soil borrowing will occur on the 184 <br /> acres No increase in current permitted daily tonnage or land refuse foot print will occur under <br /> this application. The project site is located 2 miles south of Arch Road, on the west side of <br /> Austin Road(southwest of Stockton). <br /> ENVIRONMENTAL ISSUES: <br /> 1. Water <br /> 1.a. The project site is located within FIRM (FEMA Federal Insurance Rate Map) panels 060299 <br /> 0465C (April 2, 2002), 060299 0605B(December 16, 2005), and 060299 0610 A(May 15, 1980).With <br /> the exception of areas near the creek channels,which are in Flood Zone A,the Forward Landfill site is <br /> within flood zone designations B, C and X.Any future development will have to comply with <br /> Development Title Section 9-1605 regarding flood hazards. <br /> 2. Earth <br /> 2.c. 184 acres of agricultural land is located southwest of the current permitted landfill site and <br /> according to the National Resource Conservation Service Land use capability classifications, the <br /> current soils classifications symbols for the site are 180 (Jacktone Clay) and 250 (Stockton Clay), the <br /> Storie Index rating is 20 and 25, and the soils have Class III rating if irrigated or Class IV rating if non- <br /> irrigated. Also, the 184 acres of agricultural land is under Williamson Act Contract No. 72-C1-398. <br /> Forward, Inc. served a Notice of Nonrenewal for Williamson Act Contract No. 72-C1-398, on October <br /> 13, 2005. The Notice of Nonrenewal was recorded with the San Joaquin County Recorder's Office as <br /> Document No. 2005-256394 on October 13, 2005. Pursuant to the Notice of Non-Renewal, the <br /> Williamson Act contract on the subject property will expire on March 1, 2015. However, expansion into <br /> the undeveloped southwest area of the current permitted landfill site is not permitted at this time and <br /> no increase in waste placement will occur under this proposed application this will not be a conversion <br /> of agricultural land. <br /> 3. Plant and Animal Life <br /> 3.a.& b. Based on a review of the Natural Diversity Database and recorded site visits 55 special-status <br /> animal and plant species (four federally and/or State-listed animal species) could potentially occur on <br /> the site. The San Joaquin Council of Governments has been notified and will determine if the <br /> applicant may participate in the San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan (SJMSCP). If the applicant chooses to participate in the SJMSCP, the proposed project is <br /> consistent with the SJMSCP as amended, as reflected in the conditions of project approval for this <br /> proposal. Pursuant to the Final EIR/EIS for the San Joaquin County Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP), dated November 15, 2000, and certified by the San <br /> Joaquin Council of Governments on December 7, 2000, implementation of the SJMSCP is expected <br /> to reduce impacts to biological resources resulting from the proposed project to a level of less-than- <br /> significant. If the applicant chooses not to participate, then the applicant will be required to participate <br /> in a similar mechanism that provides the same level of mitigation. <br /> Initial Study -7- Rev 5-00 <br />
