The <br /> submitted reports provide sufficient information to prepare revise Waste Discharge <br /> Requirements (WDRs)for Forward Landfill. Therefore the ROWD is complete and staff will start <br /> work on the WDRs. As we write the tentative WDRs additional information may be required, but <br /> we anticipate they will be minor in nature. <br /> Based on our earlier review, it was anticipated that Forward's food processing residual land <br /> application operation would be incorporated into the new WDRs. After reviewing the record and <br /> getting an opinion from Water Board Legal staff we have determined that the food residual <br /> operation cannot be included without completing CEQA. The operation has a County <br /> exemption from a solid waste permit under Title 27 section 21565 however, that exemption does <br /> not apply to WDRs or to CEQA. We note that the 2010 draft EIR includes the food residual <br /> operation but the current 2002 EIR does not.
