If the Discharger confirms that there is measurably significant evidence of a <br />release from the waste management unit at any monitoring point, the <br />Discharger may attempt to demonstrate that a source other than the waste <br />management unit caused the evidence of a release or that the evidence is <br />an artifact caused by an error in sampling, analysis, or statistical evaluation <br />or by natural variation in groundwater, surface water, or the unsaturated <br />zone. The Discharger may make a demonstration pursuant to Title 27, <br />section 20420(k)(7) in addition to or in lieu of submitting both an amended <br />report of waste discharge or an engineering feasibility study; however, the <br />Discharger is not relieved of the requirements and due dates of Title 27, <br />sections 20420(k)(6) & (7) unless Central Valley Water Board staff agree <br />that the demonstration successfully shows that a source other than the <br />waste management unit caused the evidence of a release or that the <br />evidence resulted from error in sampling, analysis, or statistical evaluation <br />or from natural variation in groundwater, surface water, or the unsaturated <br />zone. In order to make this demonstration, the Discharger shall notify the <br />Central Valley Water Board by certified mail of the intent to make the <br />r <br />demonstration within seven days of determining .•significant <br />evidence• shall submit-•• •II days of <br />determining • •nificant evidence of - <br />1• l <br />Within 90 days of the date that the Evaluation Monitoring Program from <br />paragraph J.1.c is approved (the date is it established), the Discharger shall <br />complete and submit the following: <br />i) Results and Assessment for the Evaluation Monitoring Program. <br />A report with the results and assessment based on the approved <br />Evaluation Monitoring Program [Title 27, § 20425(b)]. <br />ii) Updated Engineering Feasibility Study. An updated engineering <br />feasibility study for corrective action based on the data collected to <br />delineate the release and data from the ongoing monitoring program <br />required under Title 27, section 20425(e) [Title 27, § 20425(c)]. <br />iii) Amended ROWD for a Corrective Action Program. An amended <br />report of waste discharge to establish a Corrective Action Program <br />meeting the requirements of Title 27, section 20430 based on the data <br />collected to delineate the release and based on the updated <br />to engineering feasibility study [Title 27, § 20425(d)]. <br />
