STANDARD PROVISIONS AND REPORTING REQUIREMENTS, JANUARY 2012 -26- FOR 26 - FOR WASTE DISCHARGE REQUIREMENTS FOR DISCHARGES REGULATED BY SUBTITLE D AND/OR TITLE 27 description of the corrective action measures that could be taken to achieve background concentrations for all constituents of concern [Title 27, § 20420(k)(6)]. e. If the Discharger confirms that there is measurably significant evidence of a release from the waste management unit at any monitoring point, the Discharger may attempt to demonstrate that a source other than the waste management unit caused the evidence of a release or that the evidence is an artifact caused by an error in sampling, analysis, or statistical evaluation or by natural variation in groundwater, surface water, or the unsaturated zone. The Discharger may make a demonstration pursuant to Title 27, section 20420(k)(7) in addition to or in lieu of submitting both an amended report of waste discharge or an engineering feasibility study; however, the Discharger is not relieved of the requirements and due dates of Title 27, sections 20420(k)(6) & (7) unless Central Valley Water Board staff agree that the demonstration successfully shows that a source other than the waste management unit caused the evidence of a release or that the evidence resulted from error in sampling, analysis, or statistical evaluation or from natural variation in groundwater, surface water, or the unsaturated zone. In order to make this demonstration, the Discharger shall notify the Central Valley Water Board by certified mail of the intent to make the r demonstration within seven days of determining .•significant evidence• shall submit-•• •II days of determining • •nificant evidence of - 1• l Within 90 days of the date that the Evaluation Monitoring Program from paragraph J.1.c is approved (the date is it established), the Discharger shall complete and submit the following: i) Results and Assessment for the Evaluation Monitoring Program. A report with the results and assessment based on the approved Evaluation Monitoring Program [Title 27, § 20425(b)]. ii) Updated Engineering Feasibility Study. An updated engineering feasibility study for corrective action based on the data collected to delineate the release and data from the ongoing monitoring program required under Title 27, section 20425(e) [Title 27, § 20425(c)]. iii) Amended ROWD for a Corrective Action Program. An amended report of waste discharge to establish a Corrective Action Program meeting the requirements of Title 27, section 20430 based on the data collected to delineate the release and based on the updated to engineering feasibility study [Title 27, § 20425(d)].
