il. rnactzve I•�inirlg O��erations <br />Inactive mining operations are defined in Attachment 1 of <br />this General Permit. 4where comprehensive site compliance <br />evaluations, non --storm water discharge visual observations, <br />storm water discharge visual observations, and storm water <br />sampling are impracticable, facility operators of inactive <br />mining operations may instead obtain certification once <br />every three years by a Registered Professional Engineer that <br />an SWPPP has been prepared for the facility and is being <br />implemented in accordance with the requirements of this <br />General Permit. By means of these certifications, the <br />Registered Professional Engineer having examined the <br />facility and being familiar with the provisions of this <br />General Permit shall attest that the SWPPP has been prepared <br />in accordance with good engineering practices. Facility <br />operators of mining operations who cannot obtain a <br />certification because of I,:oncompliance must notify the <br />appropriate Regional Water Bcard and, upon request, the <br />local agency which receives the storm, water discharge. <br />1.2. Facility operators shall <br />prepare and submit their certifications using forms and <br />instructions provided by the State Mater Board, Regional <br />Water Board, or local agency or shall submit their <br />information on a form that contains equivalent information. <br />Facility operators whose facility no longer meets the <br />certification conditions crust notify the Regional Water <br />Boards (and local agency) within 30 days and immediately <br />comply with the Section B.S. sampling and analysis <br />requirements. Should a Regional. Water Board (or local <br />agency) determine that a certification does not meet the <br />conditions set forth below, facility operators must <br />immediately comply with the Section B.S. sampling and <br />analysis requirements. <br />
