1 .0 INTRODUCTION <br /> 1 . 1 LEGISLATIVE BASIS FOR THE PLAN <br /> In September 1986, the California State Legislature passed Assembly <br /> Bill (AB) 2948, a bill focusing on the planning and siting of hazard- <br /> ous waste facilities. Authored by Sally Tanner, this legislation <br /> calls for discretionary preparation of a separate County Hazardous <br /> Waste Management Plan in lieu of the hazardous waste portion of a <br /> county solid waste management plan. On March 24, 1987, the San <br /> Joaquin County Board of Supervisors adopted Board Order Num- <br /> ber R-87-453 declaring the County's intention to prepare a comprehen- <br /> sive Hazardous Waste Management Plan, as described in the Tanner <br /> legislation.* As a result of this action, the County has prepared a <br /> separate detailed hazardous waste management plan that updates and <br /> supersedes the existing hazardous waste element of the San Joaquin <br /> County Solid Waste Management Plan. <br /> In accordance with AB 2948, the County Hazardous Waste Management Plan <br /> (CHWMP) is to address hazardous wastes (of which infectious wastes is <br /> a subset) , extremely hazardous wastes, designated wastes, and special <br /> wastes. Excluded from consideration is radioactive waste, which is <br /> regulated by federal statutes. The waste classes addressed in the <br /> CHWMP are defined as follows: <br /> • us is a waste, or combination of wastes, <br /> which because of its quantity, concentration, physical , <br /> chemical , or infectious characteristics, may either <br /> (1) cause, or significantly contribute to an increase in <br /> mortality or an increase in serious irreversible, or <br /> incapacitating reversible, illness, or (2) pose a sub- <br /> stantial present or potential hazard to human health or <br /> environment when improperly treated, stored, transported <br /> or disposed of, or otherwise managed. The term "hazard- <br /> ous waste" includes extremely hazardous waste, unless <br /> otherwise specified (Section 25117 of the Health and <br /> Safety Code) .
