Boss <br />Emcon'Associates <br />1921 Ringwood Ave. <br />Sari Jose, California 95121 <br />Dear Sirs: <br />I am writing in response to your letter of 3/16/91 dealing with the <br />correct interpretation of the regulations concerning waste types <br />countable towards diversion. <br />Any waste type that is to be considered diverted must first be <br />quantified as disposed in the waste generation study. <br />For all three types of waste you mentioned (as for any waste type) <br />"normally disposed of" is defined in the regulations section 18720 <br />(a)(44) as comprising at least .001-1 of the total waste disposed <br />from the jurisdiction in question. In addition, the scrap metal <br />dealer must not only be able to report scrap metal amounts by the <br />specific types that are diverted, but the scrap metal must also <br />have been generated within the jurisdiction for it to be counted. <br />For example,. if the dealer has a rgianai business, the amounts <br />reported must be disaggregated amongst the contributing <br />jurisdictions. The total amounts disposed for each type of metal <br />must also be counted. <br />The other types, cattle manure and cannery food waste, must also be <br />shown to be "normally disposed of" and quantified as disposed in <br />the waste generation study, as described above. if the cattle <br />manure falls under the definition of "ag wastes" (as opposed to the <br />type ."manure" under the 01otfter organic" category, section 18722 <br />(j)), then the diversion program for this waste type must have been <br />operating as of 1/1/90 for this waste type to be considered for <br />diversion. The same criteria apply to the cannery food waste if it <br />falls under the definition of "industrial sludge" under the Special <br />Wastes category. Also, the canneries producing and diverting the <br />food wastes must -be. located within the jurisdiction wanting to <br />count this waste type in their waste generation totals (i.e., total <br />disposed plus total diverted). <br />Appendix II 1 <br />
