The land and improvements (Fixed Assets) thereon, in- <br /> cluding buildings and fencing, presently included and situated <br /> at the Landfill, now under joint ownership of CITY and COUNTY, <br /> shall continue under joint ownership. CITY and COUNTY each shall <br /> pay one-half the cost of all additions of land, improvements and 1 <br /> other major equipment acquisitions, which land, improvements, and <br /> equipment shall be owned jointly by the parties. It is the intent <br /> t <br /> of CITY and COUNTY that. CITY and COUNTY shall recover their actual <br /> t <br /> cost through charges to users of the Landfill: <br /> 3 <br /> 2. "Fixed Assets" means all equipment, land, improvements <br /> and all fixtures thereto. <br /> 3. CITY shall operate and manage the Landfill and shall <br /> i <br /> furnish all personnel, services and supplies necessary for the proper j <br /> operation of the Landfill. None of the persons working at the <br /> Landfill shall be employees of the COUNTY, but shall be employees <br /> or independent contractors of CITY. COUNTY shall have no right <br /> or authority to direct, manage or control the employees or in- <br /> "- 3 <br /> dependent contractors of CITY. <br /> 3 <br /> 4. The method and hoots°of operati*ox. of the Landfill by <br /> CITY shall be subject to approval by the COUNTY and shall be <br /> consistent with the provisions established by the State of <br /> t <br /> California, the San Joaquin Local Health District and the San <br /> i <br /> Joaquin County Solid Waste Management Plan. <br /> i <br /> 5. The dse of 'tile Landfill for disposal shall be made avail- <br /> able to all residents of the City of Tracy and the unincorporated <br /> f <br /> areas of San Joaquin County consistent with the area identified as <br /> Service Area No. 10 in the Solid Waste Management Plan for San 5 <br /> Joaquin County, and to such other areas as shall be mutually <br /> agreeable to CITY and COUNTY. <br />
