If <br /> you recall the site operator was doing some excavations to see if waste existed outside the closure cap. <br /> During excavation activities it was discovered that there was waste outside the closure cap. The area is in the <br /> Northeast corner of the property. The waste extends on to the adjacent parcel. The adjacent parcel belongs to <br /> Caltrans. Initially we(EHD, Calrecycle, RWQCB)wanted the area that was outside the closure cap to be closed as one <br /> project. Caltrans was not willing to accept any liability for the closure activities. Caltrans position was that they bought <br /> the land and did not know the waste was there and did not cause the waste to be placed there. They feel they are not <br /> responsible for closing it. They indicated that the county and maybe the City of Tracy(COT)are the responsible parties. <br /> The County Public Works Department Solid Waste Division(PWDSWD)was not willing to accept any liability for the <br /> closure cost on the adjacent parcel. The PWDSWD indicated that the COT was the operator at the time the waste was <br /> disposed of and that the COT and the current property owners(Caltrans)were responsible for the waste on the <br /> adjacent parcel.This is a civil issue and may require a court action for resolution. The PWDSWD has indicated that <br /> they would be willing to close their portion of the waste outside the closure cap, but only up to the property <br /> boundary. The violation for Final Cover has been issued for over 4 years to the PWDSWD and no progress has been <br /> made. I would like to see if there is some thing that can get this to the next phase. If Caltrans is not willing to sit down <br /> with PWDSWD to work out a solution to place a closure cap over both parcels then I think we should move forward and <br /> have PWDSWD close their side and then evaluate the options for further action from there.
