The finger pointing is not doing anyone any good. <br />I think that what needs to happen now is to get the matter resolved. There was been <br />contamination issues with the perched water in the past. The record reflects that. The <br />previous issues were high TDS and Nitrate and I am pretty sure trace VOC's (we are in the <br />middle of moving our office and I have the reports packed away). The main concern right <br />now is the gas impacts. You stated that you recommended that GW 1 be replaced. I agree <br />with you and Michael Carrol will be tasked with getting that done. As for weather or not <br />the impacts could have minimized by adequate action is arguable. The RWQCB does have the <br />lead on this issue and if they felt that what was being done was not adequate they could <br />have taken action. The probes will be inspected using a video much like the one that you <br />and John Bell demo at the site. I will work with Michael Carrol to arrange that. I will <br />let you and Todd know when that occurs. As you might remember, in late 2005 <br />(right after our site visit) and then again in early March 2006, CIWMB had prepared a <br />letter regarding the then newly discovered areas containing waste which required adequate <br />closures in co-operation with all agencies including the LEA, RWQCB and <br />CIWMB. I suggest if adequate action had taken place at that time, the <br />time we had requested it, the potential impacts to ground water, surface water and public <br />health (which you are sharing with us now) could have and might have been minimized. I <br />think you and I corresponded via <br />e-mails regarding this issue. <br />As far as the inadequate probes (plugged) at this site are concerned, you are well aware <br />that we had always raised our concerns regarding the problem with the plugged probes, <br />specially with the one we did video bore (which was discovered to contain water). I think <br />we had suggested that probe was in need of replacement. Not sure whether that was ever <br />done. <br />I think at this time as you know, RWQCB as well as CIWMB have requested the Operator to do <br />the right thing by submitting work plans to remedy the on-going problems at this site with <br />respect to discovered waste areas. The next step (which is finally what the Operator <br />appears to be <br />doing) is to determine the integrity of all of the compliance probes to assure they are in <br />good working condition that are capable to detecting <br />potential migrating landfill gas. <br />9 <br />
