State Inspection- French camp Landfill site Page 2 <br /> Facility No.- 39-AA-0002 <br /> facility is still in violation of the above State Minimum Standard <br /> (14 CCR 17710) , the facility will be scheduled for inclusion in the <br /> Inventory. Upon receipt of the notice that the facility is to be <br /> included in the Inventory, the operator will have the following two <br /> options: <br /> 1. Accept Board staff's findings and work with your agency <br /> as the Local Enforcement Agency (LEA) to attain com- <br /> pliance, in which case, the facility will be included in <br /> the Inventory; <br /> or <br /> 2. Appear before the Board to present any evidence the <br /> operator believes was not considered on the day of the <br /> reinspection that may have a bearing on staff's findings <br /> and exclude the facility from the Inventory. The request <br /> to appear must be made, in writing, to the Board no later <br /> than ten working days after receiving the notice of <br /> Inventory inclusion and results of the reinspection. <br /> once a facility is included in the Inventory, PRC § 44106 requires <br /> your agency, as the LEA, to develop a compliance schedule to ensure <br /> that diligent progress is made to bring the facility into <br /> compliance with State Minimum Standards. Facilities included in <br /> the Inventory have one year to correct the violation(s) . If the <br /> facility is not in compliance within one year of being included in <br /> the Inventory, the LEA is required to begin the process to revoke <br /> the operator's SWFP pursuant to PRC § 44106. <br /> To that end, your agency is encouraged to work with the operator to <br /> correct the above violation of Title 14 (State Minimum Standards) <br /> within 90 days. Appropriate enforcement action should be taken as <br /> necessary by your agency to achieve compliance. Please track the <br /> operator's progress in correcting the above violation on your <br /> monthly SWIS inspection reports. <br /> As always, this office is available to assist you.
