El Dorado Street <br />Stockton CA 95202-1997 <br />RE: The French Camp Landfill Administrative Hearing Compliance Agreement and <br />Application for Alternative Cover <br />The compliance agreement has been evaluated and is acceptable provided the <br />]following concerns are addressed: 1) Section VI Ponding Water states areas where <br />ponding occurs will be filled and graded to drain. To comply with CCR 17710 this <br />emergency grading shall not interfere with the approved intermediate grading plan. 2) <br />Section IV Intermediate Cover states the correction will be made within 90 days. CCR <br />17684 requires a minimum of 12 inches of cover at the END OF EACH DAY of <br />operating a lift where no additional refuse will be deposited within 180 days. <br />Pursuant to 14 CCR Section 18311 failure to meet any of the requirements of Section <br />17683 shall cause the operator to take immediate corrective action. Failure to meet <br />any one requirement for three (3) successive weeks shall cause the operator and the <br />LEA to revert to use of section 17682. <br />As discussed in the administrative hearing of January 14, 1993 once the landfill <br />reverts to the use of section 17682 it will have failed to meet the condons of CCR <br />17683. Permission to use weekly cover will be revoke an t e an w e requ rei <br />to cover daily.
