WASTE DISCHARGE RIQUIREMENTS ORDER NO. -6- <br /> FORWARD INC. <br /> FOR CLOSURE OF <br /> FRENCH CAMP MUNICIPAL SOLID WASTE LANDFILL <br /> SAN JOAQUIN COUNTY <br /> 37.,Title 27 CCR Section 20080(b) allows the Regional Board to consider the approval of an <br /> engineered alternative to the prescriptive standard. In order to approve an engineered <br /> alternative in accordance with Title 27 CCR Sections 20080(c)(1) and(2), the Discharger <br /> must demonstrate that the prescriptive design is unreasonably and unnecessarily burdensome <br /> and will cost substantially more than an alternative which will meet the criteria contained in <br /> Title 27 CCR Section 20080(b), or would be impractical and would not promote attainment <br /> of applicable performance standards. The Discharger must also demonstrate that the <br /> proposed engineered alternative cover system is consistent with the performance goal <br /> addressed by the particular prescriptive standard, and provides protection against water <br /> quality impairment equivalent to the prescriptive standard in accordance with Title 27 CCR <br /> Section 20080(b)(2). <br /> 38. California Water Code, Section 13360(a)(1) allows the Regional Board to specify the design, <br /> type of construction, and/or particular manner in which compliance must be met in waste <br /> discharge requirements or orders for the discharge of waste at solid waste disposal facilities. <br /> 39. The Discharger proposes a cover system which will be designed, constructed, and operated in <br /> accordance with the criteria set forth in Title 27, and the provisions in State Water Resources <br /> Control Board Resolution No. 93-62 for municipal solid wastes. <br /> 40. The Discharger submitted a Report of Waste Discharge requesting approval of an engineered <br /> alternative to use maximum 2.5:1 slopes on the perimeter sideslopes of the landfill. . <br /> 41. The Discharger's slope stability analysis demonstrates the proposed engineered alternative <br /> will retain integrity of the final slopes under both static and dynamic conditions. <br /> 42. Construction will proceed only after all applicable construction quality assurance plans have <br /> been approved by Executive Officer. <br /> CEQA AND OTHER CONS EDERATIONS <br /> 43. The Integrated Waste Management Board certified the final negative declaration for the <br /> facility on filed a Notice of Determination on <br /> in accordance with the California Environmental Quality Act(Public <br /> Resources Code Section 21000 et seq.) and CEQA guidelines(Title 14 CCR Section 15000 <br /> et seq.). The Regional Board considered the negative declaration and incorporated mitigation <br /> measures from the negative declaration into these waste discharge requirements designed to <br /> prevent potentially significant impacts to design facilities and to water quality.
