You have <br /> indicated that two areas of differential settlement have been noted on the landfill cover surface. <br /> You have also reported that repairs will be made during the summer of 1999. Please inform this <br /> office of your proposed mitigation methods prior to undertaking repairs. As the county is aware, <br /> maintenance of the landfill cover to correct the effects of settlement and to prevent ponding is <br /> required under the California Code of Regulations, Title 27, Section 21090, Closure and Post- <br /> Closure Maintenance Requirements for Solid Waste Landfills; and the Code of Federal <br /> Regulations, 40 CFR 258.61, post-closure care requirements. Additionally, the California Code <br /> of Regulations [CCR Title 27, Article 2, Section 21090(b)(1)(E)] states that the repair work to <br /> the low-hydraulic-conductivity layer shall be carried out in accordance with an approved <br /> Construction Quality Assurance (CQA)plan. Correction of this settlement is requested prior to <br /> 31 October 1999. <br /> Attached is a flow diagram that illustrates the steps detailed in Title 27 for responding to a release. <br /> Because the initial response to a release calls for a retest of the subject wells,please submit the retest <br /> results by 30 September 1999. In accordance with Title 27, the Regional Board is requesting that San <br /> Joaquin County submit an amended Report of Waste Discharge proposing an Evaluation Monitoring <br /> Program that will adequately delineate the lateral and vertical extent of the release. The submittal is due <br /> by 20 November 1999.
