WASTE DISCHARGE REQUIREMENTS ORDER NO. R5-2009-0049 -12- <br /> SAN JOAQUIN COUNTY DEPARTMENT OF PUBLIC WORKS <br /> HARNEY LANE LANDFILL <br /> SAN JOAQUIN COUNTY <br /> California Code of Regulations, title 23, sections 2050 and following. The State <br /> Water Board must receive the petition by 5:00 p.m., 30 days after the date of the <br /> Order, except that if the thirtieth day following the date of this Order falls on a <br /> Saturday, Sunday, or state holiday, the petition must be received by the State Water <br /> Board by 5:00 p.m. on the next business day. Copies of the law and regulations <br /> applicable to filing petitions may be found on the Internet at: <br /> http://www.waterboards.ca.gov/public notices/petitions/water quality <br /> or will be provided upon request. <br /> IT IS HEREBY ORDERED, pursuant to Sections 13263 and 13267 of the California Water <br /> Code, that Order No. 96-139 is rescinded, and that the San Joaquin County Public Works <br /> Department, its agents, successors, and assigns, in order to meet the provisions of <br /> Division 7 of the California Water Code and the regulations adopted thereunder, shall <br /> comply with the following: <br /> A. --DIS-CHARGE PRO-HIBITIONS <br /> 1 . The discharge of new or additional waste to the facility, including Landfills 1 <br /> and 2, is prohibited. <br /> 2. The discharge of solid or liquid waste or leachate to surface waters, surface <br /> water drainage courses or basins, or groundwater is prohibited. <br /> 3. The discharge of treated or untreated wastewater or groundwater to any surface <br /> water or any surface water drainage course is prohibited without a National <br /> Pollutant Discharge Elimination System (NPDES) permit authorizing the <br /> discharge. <br /> 4. The landfill shall not cause pollution or a nuisance, as defined by the California <br /> Water Code, Section 13050, and shall not cause degradation of any water <br /> supply. <br /> 5. The discharge shall not cause any increase in the concentration of waste <br /> constituents in soil-pore gas, soil-pore liquid, soil, or other geologic materials <br /> outside of the Unit if such waste constituents could migrate to waters of the State <br /> — in either the liquid or the gaseous phase — and cause a condition of nuisance, <br /> degradation, contamination, or pollution. <br /> 6. The waste discharge prohibitions herein shall supercede any conflicting or <br /> contradictory provisions in the April 2000 Standard Provisions and Reporting <br /> Requirements (SPRR) applicable to waste discharge to an active or closed <br /> landfill. See also SPRR section I.E. <br /> --B, ---D]-SC-HARGE-SP-EC1E-IOAT-I-ORIS.._ <br /> 1. The discharge shall remain within the designated disposal area at all times. <br />
