I a pledge of revenue as an acceptable mechanism to demonstrate <br /> 2 financial responsibility for postclosure maintenance activities of <br /> 3 a solid waste landfill; and <br /> 4 WHEREAS, the COUNTY established by Resolution #R-74-3362 dated <br /> 5 - November 26, 1974, the Solid Waste Enterprise Fund to ensure <br /> 6 adequate resources for operating expenses for the COUNTY owned and <br /> 7 operated refuse disposal facilitiesi and <br /> 8 WHEREAS, . the COUNTY is responsible for the administration of <br /> 9 said fund;. and <br /> 10 WHEREAS, the COUNTY has determined that projected net revenues <br /> 11 from said fund, derived from user fees charged for the use of the <br /> 12 COUNTY's solid waste facilities which include: the North County <br /> 13 Recycling Center and Sanitary Landfill (39-AA-0022) , the Foothill <br /> ® 14 Sanitary Landfill (39-AA-0004), the Corral Hollow Sanitary Landfill <br /> 15 (39-AA-0005) , and- the Staxi-- (30- a-0908) <br /> 16 -during the thirty (30) year period of postclosure maintenance of <br /> 17 the LANDFILL shall be greater during each year of this period than <br /> 18 the yearly monitoring and postclosure maintenance cost contained in <br /> 19 the most recent cost estimate for the LANDFILL, which has been " <br /> 20 submitted to the BOARD in accordance with Section - 18266 of the <br /> 21 Regulations; <br /> 22 , . NOW, THEREFORE, the parties hereto mutually agree as follows: <br /> 23 1. The COUNTY hereby establishes a pledge of revenue as the <br /> 24 financial mechanism for postclosure maintenance of the <br /> 25 LANDFILL in accordance with Sections 18283 and 18290 of the <br /> ® 2 <br />
