California Clay <br /> Landfill (SWIS Number 39-AA-0010) . Board staff reviewed the N&O <br /> with regard to criteria specified in Title 14 California Code of <br /> Regulations (CCR) Section 18304. <br /> Staff offer the following comments: , <br /> 1. Under the violations of California Code of Regulations <br /> section of the draft N&O, Sections 18263 and 18266 of 14 <br /> CCR are cited as violations for failure to submit a <br /> financial assurance mechanism for closure/postclosure <br /> maintenance to the Board. Please be advised pursuant to <br /> 14 CCR 18250(b) that "the regulations contained in this <br /> Article apply to all solid waste landfills required to be <br /> permitted. . .that were operating on or after January 1, <br /> 1988. " Board records indicate that the site stopped <br /> operating before 1/1/88 and therefore the operator is not <br /> in violation of Sections 18263 and 18266 at the time of <br /> this letter. Please contact Ms. Nancy Jestreby of the <br /> Board's Financial Assurances Branch at 916-255-2441 for <br /> guidance in this matter. <br /> (Note: If the operator begins to operate again in the <br /> future, then financial assurance mechanisms, closure/ <br /> postclosure maintenance plans, and all other requirements <br /> of Articles 3 .4 and 3 .5 will become applicable.
