Cove Contractors, <br /> Incorporated (Cove Contractors) maintains that this is an ongoing project and no new <br /> California Environmental Quality Act (CEQA) document is required. As a result, the <br /> proposed tentative WDRs will contain a statement to the effect that adoption of WDRs by <br /> the Regional Board is exempt from CEQA under §15301 of the CEQA Guidelines which <br /> provides that ongoing projects may be exempted from CEQA. <br /> Since San Joaquin County will also regulate the Cove Contractors disposal site, we are <br /> concerned that the County may arrive at a different conclusion concerning CEQA <br /> requirements. If it is the County's opinion that a CEQA document is required to resume <br /> landfilling operations, then it would be inappropriate for the Regional Board to proceed <br /> with a Section 15301 exemption. 'Therefore, we request the County's comments on <br /> CEQA. Will the County require a CEQA document prior to approval of resuming <br /> landfilling operations?
