We previously stated that the presence of ground up automobile <br />particles in your facility poses a threat to the quality of the underlying <br />ground water. Therefore, continued operation or closure of the site requires <br />submittal of the RWD or the closure plan, respectively, and compliance in either <br />case with the revised "Discharges of Waste to Land regulations, contained in <br />Subchapter 15 of Title 23, Chapter 3 of the California Administrative Code. <br />The waste in question was originally classified as 'hazardous' by the Department <br />of Health Services due to high lead levels, but later given a variance. Under <br />Subchapter 15, such variance hazardous wastes' are 'designated wastes" and <br />require disposal at a Class I or a Class II waste management unit (Section <br />2522(a)(2) and (b)]. However, this disposal requirement could be waived if the <br />discharger can demonstrate to the Regional Board "that a particular constituent <br />or combination of constituents presents a lower risk of water quality <br />degradation than indicated by [its] classification,.." (Section 2520(a)(1)) <br />Continued operation of your facility requires compliance with all the Subchapter <br />15 regulations applicable to "existing waste management units" as defined in <br />Subchapter 15. In order to comply with revised Subchapter 15 regulations, we <br />require that you submit to our office, a RWD or a closure plan by 24 February <br />1986. For your convenience, we are enclosing another set of the necessary <br />forms: blank Report of Waste Discharge, filing fee schedule, and additional <br />information request. <br />Any person failing to furnish a report requested by a Regional Board is guilty <br />of a misdemeanor and may be required to pay up to one thousand dollars ($1,000) <br />for each day in which the Violation occurs. <br />
