Marshall of the <br />California Regional Water Quality Control Board -- Central Valley <br />Region ("Regional Water Board"), regarding the above -referenced <br />site. We are pleased to learn from Mr. Marshall's letter that the <br />Water Board's "proposed tentative WDRs will contain a statement to <br />the effect that adoption of WDRs by the Regional Board is exempted <br />from CEQA under § 15301 of the CEQA Guidelines which provide that <br />ongoing projects may be exempted from CEQA." Mr. Marshall's letter <br />indicates that the Water Board is seeking confirmation from San <br />Joaquin County that a CEQA document is not required for Cove to <br />resume landfilling operations. <br />Cove Contractors is confident that the County continues, <br />as it has in the past, to consider Cove's landfilling operations to <br />be a continuing, ongoing project that does not require a CEQA <br />document at this time. To assist you in your consideration of this <br />matter, I have attached for your review a copy of the October 10, <br />1991 correspondence from Roger Lane Carrick to Mr. Ron Valinoti, <br />Director, Environmental Health Division, San Joaquin County Public <br />Health Services. Mr. Carrick's letter contains a comprehensive <br />analysis, with which both the Regional Water Board and San Joaquin <br />
