Marshall of the
California Regional Water Quality Control Board -- Central Valley
Region ("Regional Water Board"), regarding the above -referenced
site. We are pleased to learn from Mr. Marshall's letter that the
Water Board's "proposed tentative WDRs will contain a statement to
the effect that adoption of WDRs by the Regional Board is exempted
from CEQA under § 15301 of the CEQA Guidelines which provide that
ongoing projects may be exempted from CEQA." Mr. Marshall's letter
indicates that the Water Board is seeking confirmation from San
Joaquin County that a CEQA document is not required for Cove to
resume landfilling operations.
Cove Contractors is confident that the County continues,
as it has in the past, to consider Cove's landfilling operations to
be a continuing, ongoing project that does not require a CEQA
document at this time. To assist you in your consideration of this
matter, I have attached for your review a copy of the October 10,
1991 correspondence from Roger Lane Carrick to Mr. Ron Valinoti,
Director, Environmental Health Division, San Joaquin County Public
Health Services. Mr. Carrick's letter contains a comprehensive
analysis, with which both the Regional Water Board and San Joaquin
