We appreciate <br />your reconsideration of the revocation of the permit, and wanted <br />to offer you the results of our review of the applicable laws and <br />regulations. <br />Our research has not revealed authority for revoking or <br />refusing to renew a solid waste facilities permit on the basis of <br />non -receipt of waste for a given period of time. Instead, the <br />California Code of Regulations authorizes the enforcement agency <br />to issue a notice and order to correct violations of a permit or <br />standards for storing solid waste, or to correct threats to <br />public health and safety. [14 Cal.Code Regs. §18304.] As for <br />proceedings to modify, suspend or revoke a permit, the <br />Regulations authorize such action where permit conditions have <br />been violated, or the permit was obtained by misrepresentation or <br />failure to disclose relevant facts, or modification is required <br />to comply with the law or protect the public.
