G. <br />Page 3 <br />According to our conversations with personnel at the City <br />of Stockton, the City would not be involved in any of these matters <br />regarding Cove Contractors. As Mr. Ed Padilla of PHS suggested, we <br />spoke with Frank Alford, a senior planner in the Community <br />Development Department of the City about our plans for Cove, and <br />about what would be required by the City. Mr. Alford was unable to <br />provide us with this information, so we spoke with Mr. Robert <br />Ching, who is the head of the City Planning Department. <br />Mr. Ching said that when the Cove Contractors facility <br />was brought within the City limits, the facility was accepted by <br />the City as a "legal nonconforming use." He observed that the <br />County had previously authorized the operation of a landfill at <br />that location through a solid waste facility permit, so no <br />additional discretionary permit, such as a use permit, was <br />necessary from the City. He said that the City normally would <br />require a discretionary permit if someone wished to open a brand <br />new landfill, but that Cove Contractors may continue to operate <br />without such a permit from the City, because of its prior <br />authorization by the County. <br />At Mr. Ching's request, we also spoke with Steven Chen in <br />the City's Public Works Department, who is the engineer who handles <br />solid waste disposal facilities for the City. Mr. Chen explained <br />that he was responsible for the two City -owned landfills. He <br />confirmed Mr. Ching's view that the City would have no role in the <br />activities planned for the Cove Contractors facility. Instead, he <br />advised us to contact the County, the Waste Board, and the Regional <br />Board, which we assured him we already had done. Mr. Chen said <br />that he would pass on to Mr. Ching his assurances to us that the <br />City would not be involved. <br />Cove Contractors now will proceed to prepare and submit <br />the Report of Waste Discharge and Periodic site Review report <br />described above by March 31, 1990. As you suggested, we will alert <br />Cove's consultants to your limited availability beyond January 31, <br />and ask them to consult with you before then to the extent possible <br />for any clarification of the Regional Board's engineering <br />requirements.
