<br /> PARTIAL SUMMARY OF APPLICABLE LAWS AND REGULATIONS
<br /> Consult the Public Resources Code(PRC)and Tide 14,California Code of Regulations(CCR)for the complete laws and regulations listed on this form.
<br /> PRC 44002-The operation of a solid waste facility by any person,except as authorized pursuant to a solid waste facilities permit issued by the EA,is prohibited.
<br /> PRC 44004-No significant change in design or operation except in conformance with the existing permit. Application filed with LEA for modifications in design or operation of the facility
<br /> at least 120 days in advance of the date the proposed modification is to take place.
<br /> PRC 44014(b)-The permit shall contain all terms and conditions that the EA determines to be appropriate for the operation of the solid waste facility. The operator shall comply with all
<br /> terms and conditions of the permit.
<br /> TITLE 14,CCR
<br /> 17856(c)-Agricultural material composting operations which use agricultural material and/or green material that sell or give-away more than 1,000 cubic-yards of compost per year,shall
<br /> have no more than 12,500 cubic yards of green material on site at any one time,unless approved by the EA.
<br /> 17862.1(0-Each load of green material is removed from the site within 48 hours of receipt or up to 7 days as approved by the EA.
<br /> 17863-Compostable material handling facilities shall file an RCSI with the EA. If the operator intends to alter the feedstock,the EA must be notified.
<br /> 17863.4-All compostable material handling operations and facilities shall prepare,implement and maintain a site specific Odor Impact Minimization Plan.
<br /> 17865(a)-Operations and facilities located atop dosed landfills shall meet postdosure land use requirements;(j1 operations and facilities sited on intermediate cover shall locate
<br /> operations areas on foundation substrate that is stabilized.
<br /> 17866-Operations and facilities shall be designed so that the operational requirements in Article 6 can be complied with,and be designed by engineers and other professionals based on
<br /> appropriate data(for facilities,the design shall accompany the RCSI).
<br /> 17867-Operations and facilities shall:(a)W not process mammals,except when from the residential sector or food service industry;110 minimize vectors,odors,litter,hazards,
<br /> nuisances,noise,dust,and pathogens;Igo conduct random load checks for contaminants;JgH prevent contamination of compost that has undergone pathogen reduction with
<br /> materials that have not;f@JJ5J prevent unauthorized human or animal access;JIM control traffic flow;Jq0 post legible signs at all pgtk entrances(if open to the public).Signs shall
<br /> include the name of the operation or facility,name of the operator,facility hours of operation,materials that will or will not be accepted,schedule of charges,and phone number where
<br /> operator can be readied in case of emergency;flij provide fire prevention,protection,and control measures,including temperature monitoring of windrows,adequate water supply,
<br /> isolation of potential ignition sources from combustible materials,and fire lanes to allow fire control equipment access to all operation areas;(a!L)provide telephone or radio
<br /> communication; a 10 remove physical contaminants and refuse from the site within 7 days;(1U provide ventilation at enclosed operations and facilities;JIM control leachate;
<br /> a13 prevent or remove contaminants that may cause injury to humans;1&14)have an attendant on duty if open to the public.
<br /> 17867.5-Personnel trained in subjects pertinent to operations and maintenance,records maintained.
<br /> 17868.1-Operations that sell or give away greater than 1,000 cubic yards of compost annually and all facilities shall: take and analyze a composite sample of compost product,in the
<br /> manner indicated in this section,to verify that metal concentration limits are not exceeded and pathogen reduction requirements have been met. An operator who composts green
<br /> material,food material,or mixed solid waste shall take and analyze one composite sample for every 5,000 cubic-yards of compost produced. An operator who composts biosolids shall
<br /> meet the sampling schedule described in Table 1 of this section.
<br /> 17868.2-Compost product that exceeds the maximum acceptable metal concentrations shall be designated for disposal,additional processing,or other use as approved by the
<br /> appropriate agencies.
<br /> 17868.3-(a)Compost product that exceeds the maximum acceptable pathogen concentrations shall be designated for disposal,additional processing,or other use as approved by the
<br /> appropriate agencies. M Fecal coliform in compost shall be less than 1,000 Most Probable Number per gram of total solids(dry weight basis)and the density of Salmonella sp.
<br /> bacteria shall be less than three(3)Most Probable Number per four(4)grams of total solids;1b10 Enclosed or within-vessel operations and facilities shall maintain compost at a
<br /> temperature of 55 degrees Celsius(131 degrees Fahrenheit)or higher for a pathogen reduction period of 3 days andb( )(2)(A)submit a system-specific temperature monitoring plan with
<br /> the permit application to meet these requirements;IM Windrow composting-active compost shall be maintained under aerobic conditions at a temperature of 55 degrees Celsius or
<br /> higher for a pathogen reduction period of 15 days. During this period,the windrows shall be turned a minimum of five(5)times;&JU4 Aerated static oils all active compost shall be
<br /> covered with 6 to 12 inches of insulating material and maintained at a temperature of 55 degrees Celsius for a pathogen reduction period of 3 days;ll Alternative pathogen reduction
<br /> methods approved by the EA;u MonitoringEach day during the pathogen reduction period,at least one temperature reading shall be taken every 150 feet of windrow or every 200
<br /> cubic-yards of active compost,or fraction thereof. Windrows and agitated bays shall be monitored 12 to 24 inches below the pile surface. Aerated static piles shall be monitored 12 to 18
<br /> inches from the point where the insulation cover meets the alive compost.
<br /> 17868.5-Feedstock is considered green material if the following are met:ll feedstock undergoes load checking to ensure physical contaminants are no greater than 1.0 percent of total
<br /> weight;a minimum of one percent of daily incoming feedstock volume or at least one truck per day,whichever is greater,shall be inspected visually;jbl representative sample collected
<br /> and weighed for contaminants;(c)agricultural material handling operation ensures that the metal concentration limits of Section 17868.2 are not exceeded;0)personnel are adequately
<br /> trained to perform these activities;(e)records are maintained demonstrating compliance with this section.
<br /> 17869-Operations and facilities shall:la1 keep records in one accessible location for 5 years;ll record special occurrences(including methods to resolve problems arising from these
<br /> events and details of incidents that required emergency procedures);ll record public complaints received by the operator(including nature of complaint;date complaint was received;
<br /> name,address,and telephone number of complainant;and any actions taken to respond to the complaint);(d)record the quantity and type of feedstock received and quantity of compost
<br /> and chipped and ground material produced;jeej record the number of load checks performed and loads rejected;jfl record all test results resulting from compliance with Article 7,
<br /> including metal concentrations,fecal coliform and Salmonella sp.densities,temperature measurements,and dates of windrow turnings,and retain records detailing pathogen reduction
<br /> methods;(g)record and retain records of any serious injury to the public;ll record all training and instruction required by 17867.5.
<br /> 17870-Operations and facilities shall:ll provide the EA written notice of intent to perform site restoration,at least 30 days prior to beginning restoration;u provide site restoration
<br /> necessary to protect public health,safety,and the environment,((cc)ensure that the site restoration procedures detailed in this Section are performed upon completion of operations and
<br /> termination of service.
