Box 2643 <br /> Union City, CA 94587 <br /> RE: 20500 Holly Drive,Tracy, CA 95304(APN 212-160-10). <br /> San Joaquin County,Environmental Health Department(EHD)conducted an inspection on May 31,2017 at the above <br /> referenced property.During this inspection a large accumulation of green waste was observed on site. The amount of <br /> material on site was measured to be approximately 60428 cubic yards. This business does not have a use permit to <br /> operate at this location. The accumulation of green waste on the property is a violation of State Law/Regulation and <br /> County Ordinance: <br /> 1. Public Resources Code(PRC), Section 44002(a)(1) <br /> 2. California Code of Regulations(CCR),Title 14,Division 7, <br /> • Section 17857.1; Green Material Composting Operations and Facilities. <br /> • Section 17867; General Operating Standards. <br /> • Section 17870; Site Restoration. <br /> 3. San Joaquin County Ordinance(SJCO),No.2887, <br /> • Chapter 4, Section 5-2400;Accumulation of refuse, waste,and filth is prohibited. <br /> • Chapter 4, Section 5-2403;Frequency of service. <br /> • Chapter 6, Section 5-2600; Disposal area permit required. <br /> • Chapter 6, Section 5-2603;Use permit required. <br /> According to the PRC, Section 45000,45005, and 45011,the EHD has the authority to: issue an administrative order <br /> requiring the owner or operator of a solid waste facility to take corrective action as necessary to abate a nuisance,cease <br /> and desist any improper action,and establish a time schedule according to which the facility shall be brought into <br /> compliance. <br /> Effective immediately cease and desist all unauthorized disposal of solid waste onto the above referenced property. All of <br /> the material on site must be removed from the property. Retain all disposal receipts for material hauled for disposal. <br /> Proper sampling must be conducted for all material that will be removed for land application purposes. All violations <br /> must be corrected by June 19,2017.
