Cortese (See "Exhibit A"). Green waste from the <br />operation was left on site; and <br />WHEREAS, on May 25, 2017, Stephen A. Cortese contacted EHD and an inspection was <br />scheduled for May 31, 2017; and <br />WHEREAS, EHD conducted a scheduled inspection of the site on May 31, 2017 with <br />Stephen A. Cortese present. During this inspection the amount of green waste stored on site was <br />measured to be approximately 60428 cubic yards of material (See inspection report and notes <br />under "Exhibit B"). <br />WHEREAS, Holly Commerce Center, LLC is the legally responsible party for the <br />handling of solid waste that has occurred or is occurring at this location, without the required <br />permits and in violation of PRC Sections 44001 and 44002(a); and <br />THEREFORE, PURSUANT TO PRC SECTIONS 44002, 45000, 45011, AND Holly <br />Commerce Center, LLC IS ORDERED TO: <br />1. Remove all green waste from the site and complete site restoration pursuant to Title 14 <br />CCR section 17870 by December 10, 2017. <br />2. Monitor temperature of green waste on a regular basis and take immediate action to <br />reduce temperature of hot piles upon discovery. <br />3. Provide evidence of sampling pursuant to Title 14 CCR section 17868.2 and Title 14 <br />CCR section 17868.3(b)(1). <br />4. Submit disposal receipts for all green waste removed for disposal. <br />5. Submit documentation required above to: San Joaquin County Environmental Health <br />Department, 1868 E. Hazelton Avenue, Stockton, CA 95205-6232. <br />PLEASE TAKE NOTICE THAT PURSUANT TO PRC SECTIONS 45010.1, 45011, <br />45014, AND 45023, if the above actions are not completed or complied with by the specified dates, <br />EHD may: <br />-2- <br />
