Box 2009 <br /> Stockton, CA 95201 <br /> Re: Solid Waste Facility Inspection— Forward Landfill & <br /> Forward, Stockton Scavenger , commercial Salvage and <br /> Independent Trucking Transfer Station <br /> Dear Mr. Miller: <br /> The Presley Legislation (SB 1346 , 1982) authorizes the California <br /> Waste Management Board to conduct inspections of solid waste <br /> facilitiers to ensure compliance with the State Minimum Standards <br /> for Solid Waste Handling and Disposal. The Board will be inventory- <br /> ing about .20% of all California ' s solid waste facilities each year. <br /> The State Inventory Program evaluates transfer stations as well as <br /> open, closed, and illegal disposal sites. Facilities found to be <br /> out of compliance after the first inspection will be allowed a 90 <br /> day period for corrections to be made. If compliance is not <br /> achieved at the end of 90 days, the name of the facility will be <br /> subject to designation by the Board as a non-complying solid waste <br /> facility. If such a designation is made, the facility will have up <br /> to a year to achieve compliance or the operating permit will be <br /> subject to revocation. After designation the LEA shall develop <br /> and implement a compliance schedule to correct the noted <br /> violations. In the case of closed facilities, the responsible <br /> . parties will be held to a stricter standard of civil liability in <br /> the event the property owner is sued. <br /> My staff will inspect the facilities referred to before June 30, <br /> 1985. Notification letters will not be sent by Board staff to <br /> opera t.ors/owners of the facilities to announce the upcoming in- <br /> spection. You may use your discretion, whether or not to formally <br /> notify them. <br /> We wish to stress that the California Waste Management Board wants <br /> to conduct this program in close coordination with you and your <br /> staff. Our assigned county-staft'person will arrange the date and <br /> time of the evaluation so that you or your staff can accompany us <br /> during the inspection. <br /> If you have any questions, please contact your assigned staffperson. <br /> Sincerely,,..,,, <br /> John K.
