- Used oil must be stored in tanks or contain- <br />ers in good condition. Tanks and containers must <br />be made of non -earthen, non -absorbing, rust -re- <br />sistant material such as steel or oil -resistant plastic, <br />and have adequate structural support to contain the <br />used oil. "Good condition" means no severe rust- <br />ing, no apparent structural defects or deterioration, <br />and no leaking. All tanks and containers must have <br />tight -fitting lids that are kept closed except when <br />used oil is being added or removed. Regular <br />inspections and routine maintenance of all stor- <br />age tanks and containers are required. Faulty <br />tanks and containers must be repaired or replaced. <br />• Secondary containment for storage tanks is <br />required. Secondary containment is a backup <br />containment system designed to prevent the release <br />and migration of wastes or accumulated liquids out <br />of a storage tank or a storage tank system Examples <br />of secondary containment systems include: an im- <br />pervious barrier such as a liner, a vault, a double - <br />walled tank or an impervious bermed area. <br />• Aboveground storage tanks and containers <br />accumulating used oil, and fill pipes used to <br />transfer used oil into underground storage tanks <br />must be labeled with the words "USED OIL - <br />HAZARDOUS WASTE," the initial date of ac- <br />cumulation, and the name and address of the <br />generator. For shipping, containers must also <br />be labeled with the following: <br />• The statement: "Hazardous Waste - State <br />and Federal Law Prohibit Improper Dis- <br />posal. Used <br />oil determined to contain more than 1,000 ppm <br />total halogens is presumed to have been mixed <br />with halogenated hazardous waste. Used oil <br />containing more than 1,000 ppm total halogens <br />must be managed as a Resource Conservation <br />and Recovery Act (RCRA) hazardous waste un- <br />less the used oil can be demonstrated not to have <br />been mixed with halogenated hazardous waste <br />(i.e., unless the presumption is rebutted).
