O.Box 93 Tracy, CA 95378 NOTICE OF NONCOMPLIANCE, TRACY MATERIALS RECOVERY AND SOLID WASTE TRANSFER,WDID NO. 5S39S004457, SAN JOAQUIN COUNTY Enclosed is a copy of a memorandum covering our inspection on 21 March 2001. The inspection was conducted to determine compliance with the State Water Resources Control Board Order No. 97-03- DWQ,NPDES General Permit No. CAS000001, for Discharges of Storm Water Associated with Industrial Activities (General Permit). We found the following water quality issues at the site: 1. The Tracy Materials Recovery and Solid Waste Transfer Facility(Facility) is in violation of Chapter 5.9 of the California Water Code. Chapter 5.9 requires any person discharging storm water associated with industrial activity that has not obtained coverage under the General Permit, shall submit to the Board, within 30 days from the date on which a notice is sent by the Board, the appropriate notice of intent to obtain coverage or a notice of nonapplicability that specifies the basis for not needing to obtain coverage under an General Permit. 2. If operations at 205 E. 3rd Street have ceased, you must file a Notice of Termination(NOT) to the State Board. 3. The Facility needs to characterize the washwater from the truck washing facility to determine if significant pollutants are being discharged into the storm water pond. To address the two concerns above,by 17 May 2001,please submit the following: 1.
