O.Box 93 <br /> Tracy, CA 95378 <br /> NOTICE OF NONCOMPLIANCE, TRACY MATERIALS RECOVERY AND SOLID WASTE <br /> TRANSFER,WDID NO. 5S39S004457, SAN JOAQUIN COUNTY <br /> Enclosed is a copy of a memorandum covering our inspection on 21 March 2001. The inspection was <br /> conducted to determine compliance with the State Water Resources Control Board Order No. 97-03- <br /> DWQ,NPDES General Permit No. CAS000001, for Discharges of Storm Water Associated with <br /> Industrial Activities (General Permit). <br /> We found the following water quality issues at the site: <br /> 1. The Tracy Materials Recovery and Solid Waste Transfer Facility(Facility) is in violation of Chapter <br /> 5.9 of the California Water Code. Chapter 5.9 requires any person discharging storm water <br /> associated with industrial activity that has not obtained coverage under the General Permit, shall <br /> submit to the Board, within 30 days from the date on which a notice is sent by the Board, the <br /> appropriate notice of intent to obtain coverage or a notice of nonapplicability that specifies the basis <br /> for not needing to obtain coverage under an General Permit. <br /> 2. If operations at 205 E. 3rd Street have ceased, you must file a Notice of Termination(NOT) to the <br /> State Board. <br /> 3. The Facility needs to characterize the washwater from the truck washing facility to determine if <br /> significant pollutants are being discharged into the storm water pond. <br /> To address the two concerns above,by 17 May 2001,please submit the following: <br /> 1.
