MacArthur Drive, Tracy, Ca. 95377 <br /> • Conditional Use Permit#UP-PA-0800005, February 6, 2012 <br /> • California Environmental Quality Act (CEQA) Mitigated Negative Declaration — <br /> State Clearinghouse # 2011102013 <br /> State Water Resources Control Board <br /> • Conditional Waiver from Waste Discharge Requirements for Certain Composting <br /> Operations, Board Order No. 96-10. <br /> San Joaquin Valley Air Pollution Control District <br /> • Permit to Construct—# N-3187-4-0 <br /> Five-Year Solid Waste Facility Permit Review <br /> The California Integrated Waste Management Board (CIWMB) concurred with the <br /> current Solid Waste Facility Permit for the Tracy MRF/TS in February 1997. A Five-Year <br /> Review Report pursuant to Section 21675 of the California Code of Regulations was <br /> prepared by Local Enforcement Agency in February, 2002, in March 2007, and again in <br /> March 2012, defining no changes existing operations and without considering the <br /> expansion proposed herein. <br /> Regulatory Requirements <br /> The California Department of Resources Recycling and Recovery (CalRecycle) <br /> oversees the permitting of the Tracy Material Recovery Facility and Transfer Station <br /> under regulations contained in California Code of Regulations (CCR), Title 14, Division <br /> 7, Chapter 3.1. In particular, 14 CCR, section 17863 requires the operator to submit a <br /> Report of Composting Site Information, as part of their Solid Waste Facility Permit <br /> (SWFP) application to CalRecycle's Local Enforcement Agency (LEA), as defined in <br /> Section 18227 below. <br /> Each operator of a compostable material handling facility that is required to obtain a <br /> Compostable Materials Handling Facility Permit, as specified in Title 27, California Code <br /> of Regulations, Division 2, Subdivision 1, Chapter 4, Subchapter 1 and Subchapter 3, <br /> Articles 1, 2, 3, and 3.1 (commencing with section 21450), shall, at the time of <br /> application, file a Report of Composting Site Information with the EA as required by <br /> section 17863 of this Title. A Report of Composting Site Information shall contain the <br /> following. <br /> This RCSI format allows CalRecycle and the Local Enforcement Agency (LEA) to <br /> clearly review all aspects of the California Code of Regulations - Title 14 are fully <br /> addressed in conjunction with the issuance of a Solid Waste Facility Permit and its <br /> corresponding terms and conditions. <br /> (a) A description of the processes to be used, including estimated quantities of <br /> feedstocks, additives, and amendments. <br /> 3 <br />
