Responsible Party Identification <br /> Responsible party means the person or business that is the legal owner of the PW. <br /> When the responsible party can be identified, they can be held responsible for the cost <br /> associated with the proper disposal of the PW. It is important to identify the responsible <br /> party so they can be notified that they illegally disposed of PW at a facility that is not <br /> authorized to accept it and that they must make arrangements for the pick-up and <br /> proper disposal of the waste. This action helps to ensure the responsible party will <br /> follow proper disposal procedures in the future. When the responsible party cannot be <br /> identified, the facility becomes the legal owner of the PW and must pay for the proper <br /> handling, transportation and legal disposal of the PW. The following are the necessary <br /> steps that the load checker must take to identify the responsible party. <br /> 9.1. Onsite Responsible Pa E!y Identification <br /> When PW is found in self haul loads, the responsible party is normally the same <br /> as the hauler and the waste can be returned to the responsible party at the time <br /> of the load check. It is still important to record the responsible party information <br /> on the load check form to help prevent the same responsible party from <br /> continuing to bring PW to the facility. The following information should be <br /> recorded: <br /> • Vehicle license plate number, <br /> • Customer name, <br /> Aft <br /> • Disposal receipt number, etc. <br /> 9.2. OffsIte Resoonsible Partv Identification <br /> When PW is found in waste loads hauled by contracted commercial waste <br /> haulers the responsible party is not the driver of the vehicle. In these situations <br /> the responsible party is the person that hired the hauling company to pick up and <br /> deliver the waste to the facility. The following information should be recorded to <br /> identify the offsite responsible party: <br /> • Franchise hauler order ticket. Most drivers carrying roll off containers will have <br /> this ticket, <br /> • Dominions such as envelopes with addresses found within the waste load, <br /> • Statements from the driver as to the origin of the load. Many drivers will know <br /> where they picked, up the waste and the name of the business or person that is <br /> responsible for the PW. <br /> 10.9qR2_rt'!_ng <br /> im. Incidental Amounts <br /> When incidental amounts of PW are found during routine load checking <br /> activities, the "Load Check/incident" form will be filled out. The following copies <br /> of the form will be forwarded and filed in the following manner: <br /> • Original copy turned into the Operations Manager for his/her review and filing in <br /> a Binder on his/her desk. The originals will then be made available to the Local <br /> Enforcement Agency. <br /> 14 <br />
