Steve indicated that the egg-laying operation was closed and that <br /> there were no chickens at the facility located at 15401 S Wagner Rd, Escalon, CA 95320. Steve <br /> stated that he would secure the manure pits at the facility by bolting down plywood over the <br /> openings and notifying the Environmental Health Department(EHD) when the job was <br /> complete. <br /> The EHD is concerned that plywood will deteriorate quickly over time and that the manure pits <br /> will become a falling hazard, especially for young children who could fall into the pit and <br /> become trapped. <br /> The California Health& Safety Code §115700 states that"Every person owning land in fee <br /> simple or in possession thereof under lease or contract of sale who knowingly permits the <br /> existence on the premises of any abandoned mining shaft, pit, well, septic tank, cesspool, or <br /> other abandoned excavation dangerous to persons legally on the premises, or to minors under the <br /> age of 12 years, who fails to cover, fill, or fence securely that dangerous abandoned excavation <br /> and keep it so protected, is guilty of a misdemeanor." <br /> Garrett left a message by telephone for Gervase Farms on November 6, 2006 which stated that <br /> the EHD will accept one of the following procedures to secure the manure pits: <br /> • Bolt down metal plates over the manure pit openings. <br /> • Destroy the concrete pits and fill any voids with soil. <br /> • Surround the concrete pits with chain link fence and install a gate with a lock. <br /> The EHD has not been notified by Gervase Farms that the manure pits have been secured or <br /> destroyed. <br /> Page 1 of 2 COPY <br />
