Pollutant-free wastewater means rainfall, groundwater, cooling waters, <br /> and condensates that are essentially free of pollutants. <br /> 2. The Discharger shall conduct the chronic toxicity testing specified in the Monitoring and <br /> Reporting Program. If the testing indicates that the discharge causes, has the reasonable <br /> potential to cause, or contributes to an in-stream excursion above the water quality objective for <br /> toxicity, the Discharger shall submit a workplan to conduct a Toxicity Reduction Evaluation <br /> (TRE) and upon approval conduct the TRE, and this Order will be reopened and a chronic <br /> toxicity limitation included and/or a limitation for the specific toxicant identified in the TRE <br /> included. Additionally, if a chronic toxicity water quality objective is adopted by the State <br /> Water Resources Control Board, this Order may be reopened and a limitation based on that <br /> objective included. <br /> 3. Neither the discharge nor its treatment shall create a nuisance or pollution as defined in <br /> Section 13050 of the California Water Code. <br /> 4. The Discharger shall comply with all the items of the "Standard Provisions and Reporting <br /> Requirements for Waste Discharge Requirements (NPDES)", dated I March 1991, which are <br /> Dart of this Order. This attachment and its individual paragraphs are referred to as "Standard <br /> Provisions)". <br /> 5. The Discharger shall submit a Sludge Management Plan by 1 December 1997, to comply with <br /> Sludge Management Specifications D.I and D.2. This plan shall include a monitoring program <br /> to allow determinations of compliance with the Sludge Management Specifications. This <br /> monitoring will be included as part of the attached Monitoring and Reporting Program. <br /> 6. The Discharger shall comply with all pretreatment requirements contained in 40 CFR, Part 403, <br /> and shall be subject to enforcement actions, penalties, fines and other remedies by EPA or other <br /> appropriate parties, as provided in the Clean Water Act, as amended. The Discharger shall <br /> implement and enforce its approved Publicly-Owned Treatment Works (POTV�o Pretreatment <br /> Program which is hereby made an enforceable condition of Pretreatment Program which is <br /> hereby made an enforceable condition of these requirements. EPA may initiate enforcement <br /> action a_rainst an industrial user for noncompliance with applicable standards and requirements <br /> as provided in the Clean Water Act. In order, to comply with this Provision, the Discharger <br /> shall comply with the following time schedule. <br /> Date <br /> a. Submit the results of an industrial user survey. 1 Jan 1998 <br /> b. Submit an Inspection and Monitoring Program. 1 Feb 1998 <br /> C. Submit specific effluent limitations (local limits) 1 April 1998 <br /> For the general prohibited pollutants which shall <br /> Incorporated into the pretreatment ordinance. <br />
