CALIFORNIA 95202 JOHN A. wlLaoN
OAV10 P. WHIT RIDGE TELEPHONE 12091 943-5551 11D17-1®a a1
June 5 , 1989
San Joaquin Local
Health District
P.O. Box 2009
Stockton, CA 95201
Attention: Dr. Jogi Khanna
Re: Hearing Panel--Solid Waste
Facilities Permit
Dear Dr. Khanna:
When I was at the Health District last week, Ron
Valinoti posed the question:
Can the new San Joaquin Health Advisory
Board (formerly the Board of Trustees)
serve as the Hearing Panel in connection
with the Solid Waste Facilities Permit
process?
Section 66796.31 of the Government Code provides
that the enforcement agency may grant exemptions from the
permit process , but only after a public hearing. That
section, however, does not define who conducts the public
hearings .
A hearing panel is defined and established pursuant
to Section 66796.58, which reads as follows :
"All hearings required to be conducted under this
chapter shall be conducted y a hearing panel of five
persons appointed by the local governing body. The
hearing panel shall be appointed by the local governing
body under either of the following alternatives :
(1) The local governing body may appoint itself
as the hearing panel; or
(2) An independent hearing panel may be appointed.
