Box 2009 <br /> Stockton, CA 95201 <br /> Attention: Dr. Jogi Khanna <br /> Re: Hearing Panel--Solid Waste <br /> Facilities Permit <br /> Dear Dr. Khanna: <br /> When I was at the Health District last week, Ron <br /> Valinoti posed the question: <br /> Can the new San Joaquin Health Advisory <br /> Board (formerly the Board of Trustees) <br /> serve as the Hearing Panel in connection <br /> with the Solid Waste Facilities Permit <br /> process? <br /> Section 66796.31 of the Government Code provides <br /> that the enforcement agency may grant exemptions from the <br /> permit process , but only after a public hearing. That <br /> section, however, does not define who conducts the public <br /> hearings . <br /> A hearing panel is defined and established pursuant <br /> to Section 66796.58, which reads as follows : <br /> "All hearings required to be conducted under this <br /> chapter shall be conducted y a hearing panel of five <br /> persons appointed by the local governing body. The <br /> hearing panel shall be appointed by the local governing <br /> body under either of the following alternatives : <br /> (1) The local governing body may appoint itself <br /> as the hearing panel; or <br /> (2) An independent hearing panel may be appointed. <br />
