w <br /> Permitting&Assistance Branch Staff Report <br /> Inspection Frequency Reduction for the Martin Dairy <br /> SWIS No. 39-AA-0048 <br /> February 3, 2011 <br /> Background Information,Analysis, and Findings: <br /> This report was developed in response to the San Joaquin's County Local Enforcement Agency's <br /> (LEA) request for the Department of Resources Recycling and Recovery's (Department) <br /> concurrence on a reduction in inspection frequency for the Martin Dairy, SWIS No. 39-AA- <br /> 0048, located in San Joaquin County. This is an Exempt site that land applies cannery waste <br /> seasonally each year(for how long and when approximately). Title 27, Section 21565 exempts <br /> this activity from needing a solid waste facilities permit or other regulatory tier requirements. <br /> This report contains the Permitting&Assistance Branch staff's analysis, findings, and <br /> recommendations. The LEA has requested to change the inspection frequency from bi-monthly <br /> to annually. There is no reason to conduct inspections when there is no activity at the operation. <br /> CCR Title 14, Section 18083(a), states that the Department may approve an alternate inspection <br /> frequency for exempt sites if such an action will not result in adverse impact on public health and <br /> safety and the environment. To help the LEA determine when the land application activity is <br /> starting,the operator will contact the LEA before the first activity begins. One inspection will be <br /> conducted each operating season. That information will be relayed to CalRecycle electronically <br /> for inclusion into the SWIS database. <br /> Proposed Changes <br /> The following changes to the site inspection frequency are being proposed: From bi-monthly to <br /> annually. Any changes to the inspection frequency and reporting will be reflected in the <br /> Enforcement Program Plan(EPP). <br /> Findings: <br /> Staff recommends concurrence with the change to the site inspection frequency. The information <br /> on which staff s findings are based have been provided to the Branch Chief with this Staff Report <br /> and are permanently maintained in the facility files maintained by the Permits and Certification <br /> Division. <br /> Compliance History: <br /> No violations have been noted since the LEA has been inspecting this facility(since when?). <br /> Environmental Analysis: <br /> No environmental analysis is needed for this change. <br /> The custodian of the Department's administrative record is Dona Sturgess, Legal Office, <br /> Department of Resources Recycling and Recovery, P.O.
