Benjamin Hall - 2 — <br /> Musco Family Olive Company <br /> San Joaquin County <br /> A Letter of Credit(LOC) is an acceptable mechanism,but must be fully funded in accordance with Title <br /> 27 CCR §22206,which states the amount of required coverage must demonstrate at least the amount <br /> of the current closure cost estimate. Title 27 CCR §22243 describes the minimum requirements for a <br /> LOC. There is an example LOC Form in Appendices of Title 27 accessible on the California Integrated <br /> Waste Management Board's (CIWMB)website at <br /> http://www.ciwmb.ca. og v/Regulations/Title27/Appendices/. Please ensure that all references to the <br /> CIWMB are replaced with the Executive Officer of the California Regional.Water Quality.Control <br /> Board. We prefer that the financial mechanisms be set up separately for closure and for any foreseeable <br /> releases in support of the individual plans. <br /> We request that Musco submit: 1) a closure and postclosure maintenance plan for the surface <br /> impoundments with a fully funded financial mechanism; and 2) a plan for cleaning up any foreseeable <br /> releases with a fully funded financial mechanism by 1 October 2005. <br /> If further clarification of the requirements is needed,we are available to discuss them with you at your <br /> earliest convenience.
