OBSERVATION: A complete modified contingency plan with an assigned emergency coordinator was not posted at the facility. REGULATION GUIDANCE: The emergency coordinator or his designee must respond to any emergencies that arise. The business operator must post the following information next to telephones or in areas directly involved in the generation and accumulation of hazardous waste: the name and emergency telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of the fire department unless the facility has a direct alarm. CORRECTIVE ACTION: Immediately post the required information at the facility. Provide a statement to the San Joaquin County Environmental Health Department that the correction is complete. This is a Class II violation. 115 CCR 66266.81(a)(4)(B)Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. OBSERVATION: Bills of lading for the recycling of lead acid batteries from 10-3-17 to 10-3-19 were not found on site. -Approximately 30 spent lead acid batteries were observed inside the evidence shop. Note: Operator states that this business has been operating for two years only. Operator states that invoices for lead acid batteries have to be found, it is has been 6-9 months since last pick up. REGULATION GUIDANCE: (A)The generator shall use either the manifest or a bill of lading which fulfills the requirements of Title 13 CCR section 1161,to record the shipment of spent lead-acid storage batteries to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. (B)The generator shall retain, at the generator's place of business for at least three years, a legible copy of each manifest or bill of lading which identifies spent lead-acid storage batteries shipped to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. CORRECTIVE ACTION: Provide copies of battery core bill of lading records and a corrective action statement to the San Joaquin County Environmental Health Department within 30 days.
