Box 2000-147 <br /> South Lake Tahoe, CA 96151 <br /> SUBJECT: Port of Stockton, Wharf 9 Project, <br /> Letter from Mark Tullini , dated <br /> 1/25/1993 <br /> I am writing this review of the above noted letter and <br /> events relating to the above project to clarify what <br /> appear to be misunderstandings on the part of Mr. Tollini <br /> regarding responsibilities for actions taken. <br /> The original work done by William J, Hunter & Assocs . (WJH) <br /> was a report, prepared by me, dated March 1 , 1990, titled <br /> SITE ASSESSMENT REPORT, 2201 West Washington , Wharf 9, Port <br /> of Stockton, California. This report was addressed to Jim <br /> Thorpe Oil , Inc . (JTO) , who had either a contract or an <br /> understanding with Mr . Aldo Freggiaro, Port of Stockton, to <br /> continue with efforts to achieve a clearance with the San <br /> Joaquin County, Public health Services, Environmental Health <br /> Division (EHD) . This report summed actions taken to that <br /> date regarding excavations, sampling and testing for <br /> hydrocarbons at the Wharf 9 Site performed by JTO, and made <br /> recommendations for a number of shallow test borings in the <br /> area to test for area contamination. <br /> As detailed in a further report of mine, dated June 12, <br /> 1991 , titled GROUNDWATER INVESTIGATION REPORT, Wharf 9, Port <br /> of Stockton, the above recommendations were not implemented. <br /> Mr. Freggiaro and Mr. Richard Thorpe met with EHD and an <br /> agreement was made that a re-excavation and sampling program <br /> was in the best interest of everyone . Subsequently, JTO, not <br /> WJH, submitted a re-excavation and sampling program to the <br /> EHD, which to my understanding was approved by EHD. WJH was <br /> then engaged to conduct the sampling, describe operations, <br /> and write a groundwater investigation report using data <br /> obtained. This was done in the report noted above . The <br /> program submitted and approved was not that of WJH, although <br /> WJH believed that the re-excavation and sampling plan was <br /> adequate, and that subsequent results proved this to be so. <br /> The above noted report is a result of operations conducted <br /> as a result of the JTO proposal . <br /> On August 19, 1991 , Laurie A. Cotulla, EHD wrote a letter to <br /> Aldo Freggiaro, stating that although there appeared to be <br /> no significant soil contamination, that the status of the <br /> 1 <br />
