In correspondence dated July 3, 2007, you <br /> were directed to have the proposed interim soil vapor extraction (SVE) system in operation <br /> no later than August 20, 2007. This deadline was been extended two times, but you remain <br /> out of compliance with regulatory directives for failing to initiate the interim SVE remediation <br /> at your site. <br /> On February 24, 2009, a meeting was held to discuss your failure to come into compliance <br /> with regulatory directives. At the meeting it was agreed that you would submit a reasonable <br /> time schedule for continuation of the site investigation and implementation of the interim SVE <br /> remediation. The schedule you submitted for initiation of the interim SVE remediation was <br /> September 2010, which the EHD did not consider reasonable and you were directed in <br /> correspondence dated March 27, 2009, to have the SVE system in operation no later than <br /> December 31, 2009. This directive was reiterated in correspondence dated August 27, 2009, <br /> when you were also directed to become compliant with the groundwater monitoring and <br /> sampling schedule. <br /> The EHD has not been notified of implementation of the SVE remediation at your site. You <br /> are hereby directed to initiate the SVE remediation system within 14 days from the date of <br /> this letter; if you do not comply with this directive, your site may be referred to the Regional <br /> Water Quality Control Board Central Valley Region for enforcement action. <br /> If you have any questions please call Lori Duncan at(209) 468-0337. <br /> Sincerely, <br /> Lori Duncan, REHS Nuel C.
