Giannecchini <br /> Ernie's General Store <br /> 4407 East Waterloo Road <br /> Stockton, CA 95215 <br /> Subject: Ernie's General Store Site Code: 0888 <br /> 4407 East Waterloo Road <br /> Stockton, CA 95215 <br /> On February 24, 2009 a meeting was held at the San Joaquin County Environmental Health <br /> Department (EHD) office to discuss the status of the investigation and remediation of the above <br /> subject contaminated underground storage tank (UST) site. Present at the meeting were yourself; Art <br /> Deicke from Advanced GeoEnvironmental, Inc. (AGE), your consulting company; Ronald Van De Pol; <br /> and Margaret Lagorio and Lori Duncan from the EHD. <br /> The EHD scheduled the meeting to discuss your failure to comply with EHD directives to have an <br /> interim soil vapor extraction (SVE) remediation system operational at your site. SVE wells were <br /> installed and AGE conducted a pilot test in December 2006. In Additional Site Assessment and Soil <br /> Vapor Extraction Pilot Test Report dated January 26, 2007, AGE reported on the test end <br /> recommended installation of a permanent SVE system. The initial deadline from the EHD to have the <br /> SVE system operational was August 20, 2007. You have been granted three deadline extensions but <br /> the SVE system is still not in operation. The EHD pointed out that concentrations of methyl tertiary <br /> butyl ether (MtBE) in the groundwater samples collected from monitoring wells MW-3 and MW-4 have <br /> increased since August 2007 and that some properties in the area have private drinking water wells. <br /> Current issues with the State Water Resources Control Board Cleanup Fund (CUF) were discussed at <br /> the meeting and the EHD understands the difficulties being imposed on responsible parties by the <br /> CUF's economic situation. However, per California Code of Regulations, Title 23, owners of <br /> contaminated sites are required to investigate and remediate their sites without any guarantee of <br /> eligibility to, or reimbursement from, the CUF. <br /> As discussed at the meeting, you need to submit in writing to the EHD a schedule for continuation of <br /> the site investigation and implementation of the interim SVE remediation at your site.
