Wilson Way <br /> Stockton, CA., 95215 <br /> San Joaquin County Environmental Health Department (EHD) has received a copy of your <br /> February 8, 2002 correspondence to Brett McDaniel of BLAES Environmental Management Inc <br /> (BEM) regarding access to your property for U-Haul's offsite investigation and takes this <br /> opportunity to bring to your attention some important information. <br /> EHD is contracted with the California State Water Resources Control Board to provide regulatory <br /> oversight for the investigation and remediation of leaking underground storage tanks (UST). <br /> Responsible parties (UST owners, operators,landowners) are required under California State laws to <br /> actively investigate, delineate, and determine remedial actions in order to return the petroleum <br /> contaminated soil and groundwater to `pre-release' conditions. <br /> U-Haul has installed groundwater-monitoring wells on their property and has sampled these wells <br /> for petroleum constituents since 1991. Monitoring wells placed on the U-Haul property close to the <br /> school district property line have revealed elevated levels of groundwater contamination. The limit <br /> of the petroleum contamination (`zero-line') in the groundwater is to be laterally defined before the <br /> site is permitted to enter into the cleanup phase. Further groundwater investigation is needed to the <br /> west of NfW-6B and this,is the reason BEM requested your permission to access your property to <br /> install the required monitoring well. <br /> Your February correspondence denied U-Haul access to your property for this purpose. <br /> You should know that the responsible party for the leaking UST site, U-Haul,will handle all costs <br /> associated with this monitoring well installation and the school district should not be <br /> inconvenienced by this one or two day installation process. If contamination from the U-Haul <br /> leaking USTs is detected on your property,U-Haul will be responsible for the continued <br /> investigation and cleanup, as directed by EHD. <br /> Under California Code of Regulations Title 23, Chapter 16,Article 11, Section 2720, a "Responsible <br /> Party" is any owner of property where an unauthorized release of a hazardous substance from an <br /> underground storage tank has occurred. <br />
