In determining whether a violation is chronic or a violator is recalcitrant , the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 ( not including corrective action ) . On 11 /06/2020 , Vicky Vang- Lee of the San Joaquin County Environmental Health Department ( EHD) performed an inspection at the above referenced site . The site was found to be out of compliance . According to owner Aziz Sher, both the tanks on site still contain fuel and the monitoring panel has been disconnected for 3 weeks . The violations include but are not limited to the following : -No person shall abandon an underground storage tank ( UST) or close or temporarily cease operating an UST without approval by the EHD . ( HSC 25298) - Leak detection equipment not installed , operated , and maintained properly (CCR 2638(a ) , 26410 )) - Leak detection equipment disabled or tampered with ( HSC 25299( a ) (9) ) - Failure to operate UST system to prevent unauthorized releases including leaks , spills and overfills ( HSC 25292 . 1 ( a ) ) - Failure to comply with UST operating permit conditions ( CCR 2712 ) No owner/operator of facility may deposit or allow the deposit of petroleum into, and no person shall withdraw from , except to empty , a UST system that has a red tag affixed to the system 's fill pipe . Immediately take all necessary action to bring this UST system into compliance. Within 48 hours of receipt of this notice , empty all fuel from the UST system .
