The waste was spread out approximately 3 x 5 feet next to a smashed open tote that <br /> had contained the waste. When asked about the waste, the manager responded that it was dried so it could be thrown <br /> directly into the trash.This is how the facility had been treating and disposing of the waste.The facility then made a waste <br /> determination that the Butonal NX 4190 waste was hazardous waste. The SDS shows the LC50 to be 1-10 mg/I for an <br /> unidentified fish. The SDS states that the number was derived from the properties of the individual components in the <br /> material. <br /> Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment, storage, and <br /> disposal facility(TSDF). Hazardous waste containers also need to be labeled and closed according to Title 22 Hazardous <br /> Waste Regulations. Immediately cease disposal of hazardous waste to the trash and ensure that all future waste is <br /> hauled by a licensed hazardous waste transporter to a permitted TSDF. <br /> This is a Class I violation. <br /> #204 HSC 25201(a) Failed to obtain a permit to treat hazardous waste <br /> OBSERVATIONS:The facility is dumping Butonal NX 4190 waste onto sand to treat it by drying. The facility does not <br /> have a permit to treat hazardous waste.
