Crooks <br /> Central Valley Regional Water <br /> Quality Control Board <br /> 3443 Routier Road, Suite A <br /> Sacramento, California 95827-3098 <br /> TRACY GROUP PROPERTY, 400 SOUTH TRACY BOULEVARD, TRACY, <br /> SAN JOAQUIN COUNTY <br /> Dear Mr. Crooks: <br /> On June 27 , 1991, the Department of Toxic Substances Control <br /> (DTSC) approved the Preliminary Endangerment Assessment (PEA) for <br /> the subject Site and referred oversight to the Regional Water <br /> Quality Control Board (RWQCB) for ground water monitoring. The <br /> PEA approval letter required the Site be referred back to DTSC <br /> upon completion of the ground water investigation. On <br /> June 15, 1994 , RWQCB issued a letter stating no further action <br /> was required for ground water concerns and referred the Site back <br /> to DTSC. <br /> DTSC had planned to complete the Site investigation by <br /> verifying that the conditions in the PEA approval letter had been <br /> met. However, the PEA states that contamination at the Site <br /> resulted from a release of crude petroleum from a subsurface <br /> pipeline. Recent case law indicates this Site could be subject <br /> to the Petroleum Exclusion (Health & Safety Code section 25317) ; <br /> therefore, DTSC will not resume oversight of the project.
