The <br /> Department of Toxic Substances Control (Department) has prepared <br /> the following responses to the questions in your letter: <br /> 1. The Regional Water Quality Control Board (RWQCB) currently <br /> has the lead responsibility for oversight of the groundwater <br /> monitoring activities. Inquiries regarding specific <br /> restrictions on development and length of ground :cater <br /> monitoring should be addressed to the RWQCB. The Department <br /> has stated that development of a park above the contaminated <br /> area does not appear to present a problem. <br /> 2 . The "shallow aquifer" refers to the uppermost saturated zone <br /> identified in the Report as beginning at 13 feet and <br /> extending to the Corcoran clay layer at 300 feet. The <br /> Department does not consider the irrigation of the park' s <br /> playing fields and landscaping to be an activity that would <br /> cause substantial recharge of the shallow aquifer. <br /> 3 . Condition 3C of the Department' s letter does not preclude <br /> the construction of buildings, bleachers, or other <br /> structures on the site as long as those structures do not <br /> inhibit future investigation or remediation activities. The <br /> October 17, 1990 correspondence from the RWQCB to Eric Sung <br /> stated that the "developer and the City of Tracy (had) <br /> agreed not to develop the city park in such a manner which <br /> would prevent future investigations or remedial actions" . <br /> As lead agency the RWQCB should be contacted to discuss <br /> proposed onsite construction. <br /> 4 . The Report' s recommendations included the condition that <br /> " (no) wells in the park area or within one mile downgradient <br /> will be completed above the Corcoran clay for irrigation or <br /> industrial use purposes" . The Department did not agree with <br />
