In general, <br /> the Department concurs with the conclusions and recommendations <br /> presented in the Report; however, the Report does not completely <br /> satisfy Department concerns regarding future investigation at the <br /> site. For this reason, the Department conditionally accepts the <br /> Report and its assessment of onsite contamination provided the <br /> following actions are taken: <br /> 1) Ground water monitoring will continue under the direction of <br /> the Regional Water Quality Control Board (RWQCB) for a time <br /> period to be determined by RWQCB and not limited to one year. <br /> 2) Future ground water monitoring will include analysis for <br /> polynuclear aromatic hydrocarbons, unless further soil <br /> sampling demonstrates their absence in onsite contamination. <br /> 3) Specific conditions will be placed within the property deed <br /> prior to property transfer to the City of Tracy and will <br /> include the following: <br /> A) Excavation in the proposed park area will not exceed a <br /> depth of 10 feet below ground surface; <br /> B) No activities or practices will be conducted at the site <br /> which could cause substantial recharge of the shallow <br /> aquifer to the point of effecting significant changes in <br /> groundwater gradient; and <br /> C) No activities or practices will be conducted at the site <br /> which could inhibit future investigations or remediation <br /> activities. <br />
