The reports and <br /> letter show .that gasoline has contaminated ground water at all sites and fi'as <br /> accumulated in wells at two sites. The gasoline -is to be removed either "by <br /> bailing or pumping as it- accumulates -in 'order ,to reduce the quantity on the ground <br /> water and prevent migration off-site. . Kayo reports present a general overview <br /> of mthe. immediate problem of floating gasoline, on ground water: . however, the <br /> reports do not provide sufficient technical data to estimate product loss, areal ' <br /> and vertical extent .of contamination , a d to develop appropriate remedi4l <br /> ,I <br /> activities. _ : <br /> Several times you have asked about RegionallI Board and Locale Agency responsibil- <br /> ities under California law. In response tb your request : I _refer you to Chapter <br /> 6,7 , Division 20, of the Health . and Safety Code for underground tanks and <br /> Division 7 of the California Water Code for ground water quality protection. <br /> With regard to the actions requested below the Health and Safety. Code Sections <br /> 25297 states in part: ' <br /> "The local agency may request the following agencies to utilize <br /> that agency's authority to remedy the effects of, 'and remove, any <br /> hazardous substance which has been released from an underground <br /> storage tank: <br /> b) A regional water quality control boar d may take action' pursuant lo; <br /> to Division 7 (commencing with Section 13000) of the Water - Code k? <br /> and, for this purpose, the discharged hazardous substance shall <br /> be deemed a waste as defined in subdivision (d) of Section j <br /> 13050." 47 <br /> i <br /> .,,, <br />
