$ 3,000.00— On or before JULY 1, 2018 <br />$ 1,500.00 — On or before JULY 1,2019 <br />$ 3,750.00 made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL <br />HEALTH DEPARTMENT — ENVIRONMENTAL HEALTH DIVISION TRUST, as per the <br />following payment schedule: <br />$ 1,500.00 — On or before JULY 1, 2019 <br />$ 2,250.00 — On or before JULY 1, 2020 <br />$ 3,750.00 made payable to the SAN JOAQUIN COUNTY OFFICE OF THE <br />DISTRICT ATTORNEY, as per the following payment schedule: <br />$ 750.00— On or before JULY 1, 2020 <br />$ 3,000.00— On or before JULY 1, 2021 <br />Said payments shall be delivered to the San Joaquin County Office of the District Attorney, <br />Environmental Prosecutions Unit. <br />7. Defendant shall be penalized, as and for civil penalties, pursuant to Business and <br />Professions Code sections 17200 et seq., in addition to those civil penalties set forth in paragraphs 6, <br />ONE HUNDRED THOUSAND DOLLARS ($100,000.00). However, it is stipulated by all parties <br />that the entire additional ONE HUNDRED THOUSAND DOLLARS ($100,000.00), in civil <br />penalties shall be stayed for a period of seven (7) years on the following conditions: <br />Defendant will not violate Health and Safety Code sections 25100 et seq., as <br />described in paragraph 3 above; <br />Defendant will not violate Health and Safety Code sections 25500 et seq., as <br />described in paragraph 4 above; <br />Defendant will not violate or engage in any of the unlawful acts of unfair <br />competition as specifically set forth in the First, Second, and Third Causes of Action of the <br />Complaint filed in this action. <br />8. The ONE HUNDRED THOUSAND DOLLARS ($100,000.00) in civil penalties, <br />described in paragraph 7 above, shall immediately be due and payable as set forth in paragraph 7 <br />above, if the San Joaquin County Office of the District Attorney files Declarations that Defendant <br />- 6 - <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
