STOCKTON June 20, 2018 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 121 CCR 2712(f) Failed to submit a written response within 30 days of receiving an inspection report. <br /> An inspection was last done on 5/03/2018 and an inspection report was issued identifying information to be <br /> submitted to bring this site into compliance. This information was required to be submitted by 6/02/2018. This <br /> information has not been received resulting in a non-compliant status for this facility. An operator that receives an <br /> inspection report shall have 30 days to submit a written response that includes a statement documenting corrective <br /> actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting <br /> corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. <br /> The following violation remains open: <br /> 315-HSC 25291(e)Water in secondary containment not removed, analyzed, and properly disposed of(pre-Jul <br /> 2003). <br /> This is a repeat violation, Class Il. <br /> 301 HSC 25292.1 UST system is not operated to prevent unauthorized release, including spills and overfills. <br /> Fuel filters were observed outside of all under dispenser containments at the facility.The underground storage tank <br /> system shall be operated to prevent unauthorized releases. Immediately contact a properly licensed,trained, and <br /> certified contractor to replace or upgrade the component under permit and inspection with the EHD. <br /> This is a Class II violation. <br /> 315 HSC 25291(e)Water in secondary containment not removed, analyzed, and properly disposed of(pre-Jul 2003). <br /> Liquid was observed in the 87 product fill sump, 91 product fill sump, diesel product fill sump, Under dispenser <br /> containment sump 1/2, and under dispenser containment sump 11/12. If water could enter into the secondary <br /> containment by precipitation or infiltration, it must be removed and disposed of properly. Immediately remove this <br /> liquid, make a hazardous waste determination per Title 22 hazardous waste regulations, and manage it accordingly. <br /> Ensure that the the 87 product fill sump, 91 product fill sump,diesel product fill sump, Under dispenser containment <br /> sump 1/2, and under dispenser containment sump 11/12 are maintained free of liquid. <br /> This is a repeat violation, Class II. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by July 20th, 2018. <br /> Document reviewed: Monitoring system certification test results 2015, 2016, and 2017, employee training, <br /> response plan, financial responsibility documents, monitoring plan and May 2018 designated operator monthly <br /> inspection report. <br /> Documents provided: Return to compliance certification. <br /> Please be aware that as of January 1, 2014, facility operators are required to upload the following UST program <br /> documents into the California Environmental Reporting System (CERS): UST Monitoring Site Plan, UST <br /> Certification of Financial Responsibility, UST Response Plan, UST Letter from Chief Financial Officer(if <br /> FA0004525 PR0232601 SC333 06/20/2018 <br /> EHD 23-01 Rev.10/31/2017 Page 4 of 5 Underground Storage Tank Program OIR <br /> 1868 E.
