Marlowe Properties is currently in the <br /> final appeal process for their claim which was denied on <br /> August 8, 1992 . I support Marlowe Properties' appeal for two <br /> reasons . <br /> First, Marlowe Properties deserves appropriate placement in <br /> Priority Category B. After reviewing the correspondence <br /> between your office and Mr. Marlowe, it is clear that the <br /> Board staff has used conflicting definitions of <br /> "small business. " The Board indicated that the Fund is using <br /> Title 2, Section 1.896 and Section 15399 . 12 and subdivision <br /> (c) of Section 14837 of the California Code of Regulations <br /> without making direct reference to applicable Government Code <br /> Regulations. <br /> In your August 4, 1992 letter you make reference to the <br /> Board's compliance with Section 15399 . 12 and subdivision (c) <br /> of Section 14837 of the California Code of Regulations which <br /> states that. . .
