In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> On November 21,2018, Stacy Rivera of the San Joaquin County Environmental Health Department(EHD) performed a routine <br /> underground storage tank inspection at the above referenced site.The site was found to be out of compliance. The violations include <br /> but are not limited to the following: <br /> -Failed to obtain a 2018 permit to operate. (HSC 25284) <br /> -Failed to construct, operate,and maintain primary containment as product-tight(1/2 gallon of fuel was observed in the diesel STP <br /> sump,fuel leaks were observed under dispensers 5/6,9/10, and 11/12). (HSC 25290.1,25290.2, 25291) <br /> -On November 16,2017, Elianna Florido of the San Joaquin County Environmental Health Department(EHD) performed a routine <br /> underground storage tank inspection at the above referenced site.An inspection report was issued identifying information to be <br /> submitted to bring this site into compliance. This information was required to be submitted 30 days after receiving the inspection report. <br /> This information has not been received resulting in a non-compliant status for this facility. The outstanding violation was observed and <br /> re-cited during the November 21, 2018 inspection.
