In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). On November 21,2018, Stacy Rivera of the San Joaquin County Environmental Health Department(EHD) performed a routine underground storage tank inspection at the above referenced site.The site was found to be out of compliance. The violations include but are not limited to the following: -Failed to obtain a 2018 permit to operate. (HSC 25284) -Failed to construct, operate,and maintain primary containment as product-tight(1/2 gallon of fuel was observed in the diesel STP sump,fuel leaks were observed under dispensers 5/6,9/10, and 11/12). (HSC 25290.1,25290.2, 25291) -On November 16,2017, Elianna Florido of the San Joaquin County Environmental Health Department(EHD) performed a routine underground storage tank inspection at the above referenced site.An inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted 30 days after receiving the inspection report. This information has not been received resulting in a non-compliant status for this facility. The outstanding violation was observed and re-cited during the November 21, 2018 inspection. (CCR 2712(f)) The diesel tank must be brought into compliance to avoid the diesel UST system being red tagged 7-days from the receipt of this Notice.
