WASTE DISCHARGE REQUqbïż½IENTS ORDER NO. R5-2004-00280 -45- <br /> CITY OF MANTECA, CITY OP'LATHROP AND DUTRA FARMS <br /> WASTEWATER QUALITY CONTROL FACILITY <br /> SAN JOAQUIN COUNTY <br /> 5. There are indications that elevated temperatures in the San Joaquin River may affect <br /> migrating Chinook salmon and other fish during portions of the year. Temperature <br /> objectives in the Basin Plan and the Thermal Plan may not address the temperature <br /> parameters necessary to protect migrating fish. To evaluate the effect of a thermal <br /> temperature discharge to migrating fish, the Discharger shall conduct a comprehensive <br /> study of the effect of its thermal discharge to migrating fish in the vicinity of the discharge <br /> (with particular attention being paid to those periods when River flow is lowest and/or <br /> River or effluent temperature are highest). The Discharger shall perform the study in <br /> consultation with the Department of Fish and Game,United States Environmental <br /> Protection Agency, National Marine Fisheries Service, United States Fish and Wildlife <br /> Service, and other interested parties. <br /> A work plan for this study shall be completed and submitted to the Executive Officer by <br /> 1 September 2004. The work plan shall include a schedule for completing all work in <br /> accordance with the work plan within eighteen(18) months following work plan approval <br /> by the Executive Officer. Also, a progress report shall be submitted every six (6) months <br /> after approval of the work plan. The permit may be reopened after review of the study to <br /> incorporate Regional Board findings and requirements as appropriate. <br /> 6. Pollution Prevention Plan: The Discharger shall prepare a pollution prevention plan <br /> following California Water Code 13263.3(d)(3) for mercury. A work plan and time <br /> schedule for preparation of the pollution prevention plan shall be completed and submitted <br /> to the Executive Officer for approval by 1 August 2004. The Pollution Prevention Plan <br /> shall be completed and submitted to the Regional Board by 1 August 2005. A progress <br /> report shall be submitted every six (6) months after submittal of the work plan. Based on a <br /> review of the submitted information, this Order may be reopened for addition and/or <br /> modification of limitations and requirements for these constituents. <br /> The Discharger shall submit to the Regional Board, on or before each compliance due date, <br /> the specified document or a written report detailing compliance or noncompliance with the <br /> specific date and task. If noncompliance is reported, the Discharger shall state the reasons <br /> for noncompliance and include an estimate of the date when the Discharger will be in <br /> compliance. The Discharger shall notify the Regional Board by letter when it returns to <br /> compliance with the time schedule. <br /> 7. SIP Study: The discharge may contain dioxins that have a reasonable potential to cause or <br /> contribute to an exceedance of water quality objectives. The Discharger shall comply with <br /> the following time schedule in conducting a study of these constituents potential effect in <br /> surface waters: <br /> Task Compliance Date <br /> Submit Study Report for Dioxins 1 November 2004 <br />
